Mr. Delaney is recognized as a top national expert on PREA and has 18 years of experience at the U.S. Department of Justice enforcing the Civil Rights of Institutionalized Persons Act (CRIPA) and the Violent Crime Control and Law Enforcement Act of 1994 in adult and juvenile justice facilities. During his tenure at the Department of Justice, Mr. Delaney’s practice focused on investigating and monitoring conditions of confinement in adult and juvenile detention, correctional, and residential facilities, with an emphasis on sexual safety in confinement and general protection-from harm.
Mr. Delaney was a Vice Chair of the Attorney General’s Prison Rape Elimination Act (PREA) Working Group that finalized the Department of Justice PREA standards and served on the current Federal PREA Working Group during the implementation stage of the finalized Standards. In response to the Department’s Advanced Notice of Proposed Rulemaking and Notice of Proposed Rulemaking, he reviewed 2000 public comments from a wide variety of stakeholders including correctional agencies, advocacy groups, law enforcement agencies, and individuals. Mr. Delaney drafted several key portions of the Final Rule.
During his tenure on the working groups, Mr. Delaney worked closely with representatives from several other federal agencies and intra-agency components including the Department of Homeland Security Office for Civil Rights and Civil Liberties, the Bureau of Prisons, the National Institute of Corrections, the Office of Juvenile Justice and Delinquency Prevention, the Office of Violence Against Women, the Office of Victims of Crime, the U.S. Marshals Service, the Office of the Federal Detention Trustee, the Access to Justice Initiative, the Office of Justice Programs Office for Civil Rights, the Bureau of Justice Statistics, and the Bureau of Justice Assistance.
Mr. Delaney has been faculty at almost every PREA auditor training and has conducted numerous national and regional training sessions and webinars on the Standards and the auditing process. He served as a primary or co-drafter of the vast majority of PREA interpretive guidance documents issued by the Department of Justice. Mr. Delaney has participated in audits, investigations, reviews, and preliminary inquiries of several dozen facilities at all levels of government, including the Federal Bureau of Prisons, Department of Defense facilities, statewide confinement agencies, and county and municipal facilities.
While serving at the Department of Justice, Mr. Delaney received the Attorney General’s Award for Distinguished Service, the National Partnership for Juvenile Services’ Hammergren-Dunlap Distinguished Service Award, and numerous Special Commendations and other awards from the Department’s Civil Rights Division.
Prior to joining the Department of Justice, Mr. Delaney practiced complex litigation and regulatory affairs at the law firm WilmerHale.
Mr. Delaney received a Bachelor of Arts from Georgetown University and a Juris Doctor from the University of Baltimore School of Law.
